Actor Jussie Smollett now a suspect in criminal investigation

Smollett's lawyers have said the actor was angered and "victimized" by reports that he may have played a role in staging the attack.

The testimony would have been the first step toward indicting Smollett for filing a false police report, WBBM reported.

The Osundairos' attorney, Gloria Schmidt, hasn't responded to multiple requests for comment from The Associated Press.

A CNN report on Saturday, citing two unnamed law enforcement sources, said investigators believe Smollett may have paid the two men - Nigerian brothers with a professional connection to Smollett - to orchestrate the attack.

The horrific incident took place at East Lower Water Street, Chicago, at approximately 2am local time on January 29 it was claimed.

Empire's cast hasn't really spoken out about Jussie Smollett's story since the shift in headlines, but co-star Terrence Howard shed some light on what it felt like to be part of the cast when news of the alleged attack initially surfaced.

What was especially weird was that one of the brothers had actually worked on Empire with Smollett as an extra.

Questions have also been raised about the threatening letter Smollett said he received a week before he was allegedly attacked in Chicago.

One of those purported suspects was Jussie's personal trainer who he hired to ready him physically for a music video.

"Out of an abundance of caution, the decision to recuse herself was made to address potential questions of impartiality based upon familiarity with potential witnesses in the case", Foxx's spokeswoman Tandra Simonton said. These two brothers claim that they were paid $4,000 by Smollett to participate in the hoax. The two men, aged 25 and 27, were released late Friday, 12 hours after police called them "possible suspects".

About a dozen search warrants have been issued in the case, WBBM said, including for Smollett's financial and phone records. He also claimed they told him that it was "MAGA country", a reference to Donald Trump's campaign slogan. The "Empire" actor will now be investigated by the Federal Bureau of Investigation and U.S. Postal Inspection Service. "They get in a DUI, they call police and say, 'My auto was stolen.' Ninety percent of the time, even if they're charged with a felony, those people end up pleading to a misdemeanour". "They did not get seated before a grand jury", the Chicago Police Department said in a statement Tuesday. They have denied that Smollett staged the attack, and said he will continue to cooperate.
