Latest Weinstein Class Action Includes New Rape Claim

Harvey Weinstein has been hit with another sexual misconduct and assault complaint just days after he was indicted for his actions in NY - and this one comes with an alleged video.

Just last Friday, Weinstein was arrested and surrendered himself to authorities in New York City following multiple investigations into claims of sexual misconduct carried out by the Manhattan District Attorney's office and the NYPD.

For the record, Weinstein was indicted in New York Wednesday on charges of rape in the first and third degrees and first-degree criminal sexual act for crimes involving two women.

Thompson went to a follow-up meeting with Weinstein at a restaurant at the Tribeca Grand Hotel that same day, and the meeting quickly moved to a hotel room, the suit says.

Weinstein's lawyer, Benjamin Brafman, has said that his client intends to plead innocent.

Caitlin Dulany, Larissa Gomes, and Melissa Thompson allege they were each the target of Weinstein's predations, which were facilitated by his production companies Miramax and The Weinstein Co., along with individuals at those companies, as part of an ongoing criminal enterprise.

If convicted on the most serious charges, Weinstein could face between five and 25 years in prison.




The lawsuit sues Weinstein, a series of companies, including Disney, and named executives and unnamed plaintiffs that he has worked with, many of whom are seen as having enabled his conduct. She accused Brafman and one other lawyer who used to work for him, Alex Spiro, of utilizing "misleading ways" to make it look like they have been working for Weinstein's victims.

"To the extent he spoke with or met with any of these women, he did so on his own time after he had left this firm and was already employed by Quinn Emanuel", Brafman said.

"I never have and I never would represent Harvey Weinstein".

They are suing Weinstein - as well as Miramax and The Weinstein Company - for assault, battery and racketeering.

"Thompson was led to believe that Brafman and Spiro were representing victims against Weinstein", the law firm representing her, Hagens Berman, said in a statement. In the suit, Dulany alleges that Weinstein performed oral sex on her without her consent and then masturbated.

Brafman has said that Weinstein has never had nonconsensual sexual relations with anyone.

She handed over audio and video evidence of harassment to Spiro and later found out that Brafman was on Weinstein's defense team, the suit says.
