Lawsuit accuses Michigan State of covering up rape accusation against basketball players

The lawsuit states that the woman met the three basketball players at a bar in East Lansing on April 12, 2015 ― one week after Michigan State lost to Duke in the Final Four. When she arrived, she realized there was no party and her roommate was not there. But at no time during the night did she indicate a "romantic interest" in any of the team members, the lawsuit stated.

According to the lawsuit it happened at Harper's Bar in East Lansing in April of 2015.

One of the players on the team then offered the alleged victim to come to the player's party, and allegedly lied and said JR1 was already on the way to the party. At some point she said in the lawsuit that her glass was hard to grasp although she had not had much to drink. She was later taken to an off-campus apartment where she was told a party was going on, according to the lawsuit.

The woman said she was feeling discombobulated and couldn't control her thumbs to formulate a text on her phone, according to the lawsuit.

"I was crying. I was trying to push myself up, and I couldn't move", she told Outside the Lines. "There was no party" the lawsuit stated, "as few people were present". But another player, who lived in the apartment, later asked her if she wanted to see some of his basketball memorabilia.

The woman said she was very hungry and thirsty.

A woman alleges that she was raped in 2015 by three Michigan State University basketball players and that the university pressured her not to report the attack to authorities.

"Plaintiff does not remember anything else until she woke up on the couch a few hours later", the suit said. She then called for a taxi and went back to her dorm room at Brody Hall. There is no way of knowing because she didn't have a toxicology report done in time. She accepted. He introduced her to teammates.

Court records obtained by WOOD-TV, a sister station of WISH-TV, detail the alleged gang rape and alleged negligence by MSU officials to inform the victim of her rights. She also did not file a no-contact order and claims she was not advised by the university's counselors of that option. "The counselor's demeanor completely changed", the lawsuit reads in part. So another counseling center staff member entered.

"Plaintiff was expressly told by MSUCC staff that 'if you pursue this, you are going to be swimming with some really big fish, '" the lawsuit alleges. The plaintiff says she was told by the counseling center's staff that, among other things, filing a police report would be an "uphill battle" that could create anxiety and and unwanted media attention. At no point was she informed of her Title IX rights, protections, and accommodations.

The sexual assault allegation is the third against members of the Spartans basketball program in a span of five years. Because of the discouragement by the staff, the alleged victim did not seek SAP assistance until 10 months later.

In the room, she was given a glass of water and was "drinking the water when the room went dark", the lawsuit states. The three players are not named.

"In October 2015, Plaintiff had become so traumatized, depressed, and withdrawn to the point that she was admitted to the Sparrow Hospital outpatient psychiatric day program for intensive psychiatric treatment", the document says.

The report also says the school has changed a number of policies and procedures regarding sexual harassment and assault since Nassar's 2016 suspension from MSU.
