Kenya police keep opposition politician in custody in defiance of court order

The fiery lawyer caused drama at the airport when he refused to board a Dubai bound plane meant to re-deport him to Canada, just hours after he had landed in the country.

On Feb. 6, the self-proclaimed general of the National Resistance Movement (NRM) Miguna Miguna was deported to Canada after being arrested for swearing in opposition leader Raila Odinga as the people's president after two successive and tense presidential elections in 2017 resulted in the deaths of more than 100 people, according to human rights organizations.

Odunga said he would sentence the officials on Thursday even if they did not appear in his courtroom, but it was unclear the impact that would have.

On Tuesday afternoon a Kenyan court ordered that Miguna be released immediately and that he present himself in court on Wednesday.

Interior Ministry spokesman Mwenda Njoka said the government was just following the law in Miguna's case.

Rowdy youths on Wednesday took to the streets in Kisumu to protest the detention of Miguna Miguna at the Jomo Kenyatta International Airport.




While pointing a finger at the executive for contempt, Justice Odunga said obedience of court orders is a value of good governance within all State organs and that the directives are not subject to interpretation by any arm of government. Odinga argued that Kenyatta lacked legitimacy because his initial August 8 re-election victory was nullified by the Supreme Court over "irregularities and illegalities" in the election and the repeat ballot had a low turnout.

Since then, Raila Odinga has shaken hands with Kenyan President Uhuru Kenyatta and called for a truce saying that they will work together to unite Kenyans, a move that Miguna has termed as a "betrayal for the people of Kenya".

In a video of the airport confrontation posted on social media, Miguna declared: "You can not take me from country by force".

"They want to remove me by force and put me in a plane, purportedly that I am an undocumented person so I am not going".

The repeat election had a low turnout as Odinga boycotted it, citing a lack of electoral reforms. "I have not been given access to my lawyers, family members and physicians". The government responded by arresting opposition politicians and shutting down TV stations that broadcast the event.

The lawyer took to his Twitter account to inform Miguna's supporters about the court order.
