Second US judge blocks Trump order to end 'Dreamer' program

Both rulings ordered the government to keep processing DACA renewal requests.

A second federal judge Tuesday has temporarily blocked the Trump administration from ending the Deferred Action for Childhood Arrivals program.

A federal judge in NY ruled Tuesday that the government must restart the Obama-era Deferred Action for Childhood Arrivals deportation amnesty, adding more weight to the legal case against President Trump's phaseout of the program just as Congress is debating the fate of "Dreamers" on Capitol Hill.

"Today's court ruling out of the district court in Brooklyn shows that courts from coast to coast have sent a single clear message to President Trump: The way that he terminated DACA was not just immoral, it was unlawful", said Karen Tumlin, legal director at the National Immigration Law Center.




"The question before the court is thus not whether defendants could end the DACA program, but whether they offered legally adequate reasons for doing so", wrote Judge Garaufis, a Clinton appointee to the court in NY.

Garaufis said the administration could eventually rescind the DACA programme but that the reasons it gave last September for rescinding it were too arbitrary and could not stand. "Based on its review of the record before it, the court concludes that defendants have not done so". The DREAM Act - Development, Relief and Education for Alien Minors - was legislation that offered numerous same protections as the Deferred Action for Childhood Arrivals administrative program but never passed Congress.

Garaufis, however, said the government was "erroneous" in its conclusion that DACA was unconstitutional and that it violated the Administrative Procedures and Immigration and Nationality acts. The ruling means DACA recipients can renew their status, but the administration will not have to hold the program open to those who never applied. But he followed that up by ruling that the government still had to accept renewal applications from people now in the program. Unfortunately, unless and until an appeal can be pushed through to the Supreme Court or Congress passes a law rendering the current DACA prgram moot, the White House will probably have to abide by this ruling.

This ruling is rather odd on several fronts.
