National Party Loses Eminem Copyright Lawsuit

The party used the song during its successful 2014 election campaign before pulling the advertisement off the air. Indeed, the song, which was the centerpiece of "Eight Mile", Eminem's semi-autobiographical acting debut, won both an Oscar and a Grammy and was the rapper's longest-reigning chart hit to date, topping the Billboard Hot 100 for 12 weeks beginning in November 2002.

Cull ruled that Eminem Esque "substantially" copied Lose Yourself, to the point where the differences between the two were "minimal". "We find it incredible that the National party went to such great lengths to avoid responsibility for using a weak rip-off of 'Lose Yourself, '" he said.

"I hope it means we see more original music in advertising and those people who do want to use sound-alike's do so much more cautiously".

Martin claimed he hadn't yet discussed the judgment with Eminem, aka Marshall Mathers III, but rejoiced the rap artist hadn't been had to take a trip to New Zealand "to view the paint completely dry in the court area".

The National Party's 2014 election ads were broadcast more than a hundred times before they were replaced.




"This decision is a warning to "sound alike" music producers and their clients everywhere", said Adam Simpson, director of Simpsons Solicitors, who acted for Eminem's music company, Eight Mile Style and writers Jeff Bass and Luis Resto.

"It is no coincidence that Lose Yourself received the 2003 Academy Award for Best Original Song".

The judge based the amount of the award on a hypothetical licence fee that the party might have paid to use the song - although Eight Mile Style rarely grants permission to use Lose Yourself in advertising. It copied the essential elements that made Lose Yourselfa global hit.

National Party President Peter Goodfellow said in statement that the party purchased the music from an Australia-based library that had bought it from a USA supplier. It was calculated and intentional.

The National Party said it was disappointed with the ruling.
