Gene Simmons Filed a Legal Application to Trademark the Devil's Horns Gesture

"Gene Simmons-who also apparently plays bass and sings in a band called KISS-believes that he not only invented the, hand gesture with the index and small fingers extended upward and the thumb extended perpendicular", but that nobody else should be allowed to use it without his permission. If his application is approved, he'll add a trademark for this gesture to a seemingly endless array of other Kiss-related items - from toilet paper to coffins.

Simmons is claiming the hand gesture mark for "entertainment, namely, live performances by a musical artist; personal appearances by a musical artist".

According to Simmons' application, the hand sign was first used "as early as" November 14, 1974, a date that appears to overlap with the band's "Hotter Than Hell" tour. Here, for example, is the album cover for the Beatles" 1966 single, "Yellow Submarine/Eleanor Rigby'. He may think that he is using the infamous "devil's horns" but that gesture, as made famous by people like Ronnie James Dio, actually also holds the thumb to the palm. That appears to correspond with Kiss' Hotter Than Hell tour.




It would be ridiculous for Simmons to claim such an iconic and widely used symbol as his own, but also understandable on some level, since the horns are within his purview as a hard rocker. In some Meditteranean cultures, the "devil horns" gesture is made to a man to suggest that his wife is being unfaithful. "Then again, maybe Simmons is saying 'I love you, ' but if so, those who use sign language might not love what he's doing". See the U.S. Supreme Court's upcoming ruling in Tam v. Lee.

Can a hand gesture be trademarked? But as you can see from the photo above, and the many more available online showing Simmons' message of devotion to the ASL-speaking community, he is evidently no self-respecting metalhead.
